Abstract

Wakaf management is shifting. In the past, wakaf funds and inventory were used mainlyto support tombs and schools. Recently, they are managed for productive ends without reducingthe wakaf assets themselves. This is possible to take place after Law No. 41 (2004) was passed andthe establishment of the Body for Indonesian Wakaf Management (Badan Wakaf Indonesia -BWI) by the Government. Since then, wakaf is not only limited to non-moving assets, such asland, but it also includes cash wakaf . According to the records of Dompet Dhuafa, a non govern-mental institution that manages Islamic philanthropic funds (alms, tithes, donations and wakaf ),there is a substatial increase in the amount of wakaf money coming in. It is crucial then toimprove wakaf management to a more professional one, so that wakaf funds can benefit theMuslim community in Indonesia and increase their welfare.

Abstract

This paper outlines Islamic macro economic policy on the issue of foreign debts andoffers solutions to resolve the crisis of foreign loans in a humane and socially just manner. Eco-nomic recovery can be done by the combination of reforming the morality of business actors andstate apparatuses, changing the economic structure to a more efficient one, emphasising a maxi-mum use of economic resources, and minimising the distribution gap in society by decentralisingwealth and completely removing injustice. Improvidence and consumptive tendencies of societyand state apparatuses must be pressed and accompanied by corruption elimination. Good gover-nance and people’s confidence are two high valued assets to run the development and to create ajust and properous society.

Abstract

Normatively, Sharia economy as a part of Sharia law focuses on Islamic norms in economydeduced from al-Qur’an and al-Hadith as well as from other secondary sources. As a derivation ofIslam, Sharia economy will follow Islam in all aspects. Islam is a way of life as it provides acomplete guidance in the forms of legal norms for human beings, including in economic field.The norms of Sharia economy are: (a) partnership (b) the existence of moral drives (c) the exist-ence of social role.

Abstract

This article discusses the need to reconstruct Islamic economy curriculum in Islamichigher education. Since about ten years ago, Islamic economy has become a special concentrationin many campuses but the procces of searching its most proper study model is still ongoing. Tofulfill the market’s demands, both state and private campuses need to reconstruct their studymodel of Islamic economy by stressing the combination of Sharia and economics. This will be-come a basis for the students to produce some creative ways to develop Islamic economy accord-ing to society’s needs. The exponents of Islamic economy and the staff of departments of Islamiceconomy in higher education must formulate an instruction pattern or a standard curriculum forIslamic economy. Most importantly, the curriculum must be relevant to today’s market. Bydoing so, the alumni of the departments of Islamic economy will gain an enterpreneurship ethos,to be the masters on their own.

Abstract

This article uses historical, philosopical and legal approaches. It is historical for it traceseconomic activities back to the time of prophet Adam until prophet Muhammad. It is at the sametime, philosopical and legal in nature because there are discussions on some Qur’anic precepts oneconomy that need to be obliged. The four principles of ‘Qur’anic economy’ are tauhid, balance,free will and responsibility. Starting from tauhid, a Muslim believes that his prayers and devotions,his life and death are only for God’s sake. With balance, it is expected that no inflation, economicrecession and depression occur. With free will and responsibility, economic actors are expected towork hard and execute God’s mandates.

Abstract

Nishab is a concept in Islamic law about the minimum wealth that will make its ownerhaving an obligation to pay the compulsory alms (zakat). A standard for nishab emerges becausethe monetary values of wealth items, whose nishabs have been specified by Sharia, exist. There-fore, the idea to have a unified nishab standard is a product of ijtihad (legal thinking) that regardsthat knowing the rationality behind the obligation to give alms is possible. Islamic legal scholarshave now motivated to conclude that our textually understanding on nishab needs to be reconsid-ered. The present article focuses on the idea of nishab standard and the validity of the use of gold insetting that standard.

Abstract

Focusing on the building of entrepreneurial spirit, this article emphasises the impor-tance of Islamic values as the basis to create an independent and competitive ummah (communityof believers). It is widely convicted that our society prefer to be civil servants or employees tostarting their own businesses. This and misperception of religious values and teachings are partlyresponsible for the slow development of the entrepreneurship culture. I argue that we need to revitaliseIslamic values in order to build an entrepreneurial spirit that emphasises honesty and trustwor-thiness. Devotions should not be understood as norrowly as they have often been, and mustbecome a main motivation when one starts or runs a business. It is also crucial to teach thatdishonesty and untrustworthiness will only produce short term profits with no long term bless-ings.

Abstract

Conventional economy is different from Islamic economy. The former is based on thebehavior of economic units that is not tied to certain Sharia norms. On the contrary, the latterasserts that individual behavior is limited to Sharia rules. In practice, conventional economy onlypays attentions to changes taking place in economic variables. In contrast, not only does Islamiceconomy focuses on the changes, it also avoids what Sharia forbids. The behavior of Islamiceconomy actors is based on the theory of Islamic economy (consisting of such concepts as tauhid,‘adl, nubuwah, khilafah dan ma’ad), and its principles: ownership, freedom and social justice. In prac-ticing these, the actors of Islamic economy are guided by ethics. Rules like these are not to befound in conventional economy, in which rentseeking can distort economic pratices which maylead to business failures and economic unstability.

Abstract

Islamic Financial Units (IFU), both banks and non-banks, have main activities to col-lect funds from people (clients) and then distribute them through financing, loan and services.After the units as investors distribute the funds to business managers, there are two possibilities:the business runs well because of good management or bad management leads to an unability onthe side of the managers to pay regular installments. In a situation when a dispute occurs betweenparties involved in a financing contract, maybe in the case of non-performing loan due to badbusiness management, or because one party does not fulfill the obligation, or some imperfectionsin the financing contract lead to different ways of understanding it, the resolution mechanismsare available in either court of law or outside it. This article discusses the legal bases for disputeresolutions through both ways, which include some laws, the regulations of the Indonesian Cen-tral Bank, an Islamic bank’s dispute resolution procedure, and the legal opinion of Sharia Na-tional Council.
